Defamation, Libel, and Slander Cases

He has successfully handled defamation lawsuits for both plaintiff and defendants.

Anti-SLAPP Motions & Appeals

SLAPP is an acronym that stands for Strategic Lawsuit Against Public Participation. A SLAPP is a lawsuit that chills the exercise of free speech. In response to a disturbing increase in the number of these types of suits, in 1992, the California legislature enacted Code of Civil Procedure 425.16 (the anti-SLAPP statute) to create a procedural mechanism (anti-SLAPP Motion) by which courts could dispose of such meritless lawsuits at an early stage of litigation. Since the anti-SLAPP statute was enacted, there have been over 350 California Appellate and Supreme Court decisions interpreting its provisions. The law on this subject is constantly changing and few attorneys have substantial experience with anti-SLAPP Motions. Because this area of law is complex and is constantly changing, it is a malpractice trap for unwary attorneys. Therefore, it is important to hire an attorney with substantial experience in this area representing both plaintiffs and defendants.

Mr. Facchetti has successfully represented both plaintiffs and defendants in the anti-SLAPP context. He has also written extensively on the subject and is contacted daily by potential clients and attorneys alike seeking his advice on this complex and challenging area of law.

Mr. Facchetti offers the following services in regard to anti-SLAPP motions:

  • Evaluation of complaints to determine whether they are subject to an anti-SLAPP prior to filing
  • Review and Draft complaints in order to avoid the application of the anti-SLAPP statute
  • Representation of plaintiff and cross-complainants in opposing anti-SLAPP motions (hourly rate only)
  • Representation of defendants in support of anti-SLAPP motions (modified contingent fee arrangements available in certain circumstances)
  • Making and opposing Discovery motions (under the anti-SLAPP statute)
  • Making and opposing Fee motions (under the anti-SLAPP statute)
  • Representation of plaintiffs and defendants in appeals
  • Enforcement/collection of SLAPP fees

Other Civil Litigation Matters

Mr. Facchetti also handles a variety of other civil litigation matters, including real estate litigation, business litigation, partnership disputes, breach of contract, and more.
